ARTICLE 1 – PURPOSE

These general terms and conditions of sale set out the terms applicable to sales concluded between:

  • on the one hand, individuals wishing to make a purchase via the website https://letarn.fr, hereinafter referred to as ‘the customer’.
  • and, on the other hand, Le Tarn, which is responsible for operating the aforementioned website.

Le Tarn reserves the right to amend its Terms and Conditions at any time. These are available on the letarn.fr website. Any amendments shall take effect as soon as the amended Terms and Conditions are published online. The customer is made aware of these terms and accepts them without reservation before confirming any order.

ARTICLE 2 – PRODUCTS – STOCK

The information provided on the product pages enables customers to familiarise themselves with the product’s specifications before placing an order. Consequently, any complaint arising from a failure to check this information will not be accepted.

It may happen that a product shown as in stock at the time of ordering is no longer in stock by the time the parcel is being prepared. In this case, Le Tarn undertakes to notify the customer as soon as possible and to offer a solution that is satisfactory to both parties (replacement with another product, a refund or a credit note).

ARTICLE 3 – PRICE – PAYMENT

The prices shown on the website include all taxes (TTC), but do not include delivery charges. Le Tarn reserves the right to pass on any changes to the VAT rate to the prices shown on the website, as well as the right to amend its prices at any time. However, only the price shown at the time of ordering will apply to the customer.

Full payment for the order is required at the time of confirmation. Payment will be made via a secure credit card transaction using our partner Stripe’s payment gateway. The order will only be confirmed once payment has been received. If a payment is not confirmed, the order will be cancelled and Le Tarn will inform the customer.

For deliveries outside the European Union, customs duties or local taxes may be payable on arrival. These are to be borne exclusively by the purchaser.

Le Tarn reserves the right to refuse to fulfil an order placed by a customer who has not paid in full for a previous order or with whom a payment dispute has not been resolved. Le Tarn cannot be held liable for any fraudulent use of any means of payment.

ARTICLE 4 – DELIVERY

Deliveries are made to the address specified on the order form. The customer is responsible for the information provided to Le Tarn when placing the order. This information cannot be amended once the order has been confirmed. In the event of an error in the recipient’s contact details, Le Tarn cannot be held responsible if the items ordered cannot be delivered.

The order will be dispatched within 2 to 3 working days, counted from the first working day following the date of the order.

The customer bears the risk from the moment the goods leave Le Tarn’s premises. In the event of damage during transport, a reasoned complaint must be lodged with the carrier within three days of delivery.

ARTICLE 5 – RIGHT OF WITHDRAWAL

5.1 General principle (Non-personalised products)

All retail customers (natural persons) are entitled to a withdrawal period of fourteen (14) days from the date of receipt of the order. Regardless of the reason for withdrawal, you must notify Le Tarn within the aforementioned period by email or post, stating that you are exercising your right of withdrawal. You must then return the products as soon as possible and, at the latest, within fourteen (14) days of notifying us of your decision to withdraw. The products must be returned in perfect condition, in their original packaging, and in a state that allows Le Tarn to resell them, to the following address:

Le Tarn
1012 route de Saint Salvy, La Métairie Neuve
81390 Saint-Gauzens
France

Please note that you are responsible for the costs and risks associated with returning the goods; you will not be entitled to a refund from Le Tarn. We recommend that you keep all proof of the return. Once the goods have been received, you will be refunded the full amount paid – including the original delivery charges.

5.2 Exception for personalised products (engraving)

In accordance with Article L221-28 of the Consumer Code, the right of withdrawal is strictly excluded for contracts for the supply of goods made to the consumer’s specifications or which are clearly personalised.

Consequently, any knife that has been personalised by engraving (text, first name, date or any specific request from the Customer) is final and non-refundable. No right of withdrawal, order cancellation, return or refund will be accepted for these products once the order has been confirmed and has gone into production.

The Customer is solely responsible for the accuracy of the details entered when placing their order (spelling, case, choice of font).

5.3 Moderation and the right to refuse engravings

Le Tarn reserves the discretionary right to refuse and cancel any order for personalised engraving containing language or text that is contrary to public decency, or that is offensive, racist, hateful or xenophobic in nature, or that clearly infringes the intellectual property rights of third parties (registered trade marks). In the event of a refusal, the customer will receive a full refund for their order.

ARTICLE 6 – MANUFACTURING AND DELIVERY TIMES FOR CUSTOMISED PRODUCTS

6.1 Specific features of personalised products (Engraving)

The Customer is expressly informed that products requiring personalisation by engraving require processing time and are handcrafted in our workshop. Consequently, the dispatch times for an order containing one or more engraved products are 2 to 7 working days longer than for a standard product held in stock.

6.2 Calculating the delivery time

The overall delivery time quoted to the Customer when they place their order comprises two separate periods:

  1. Production/personalisation time: The time taken by the Le Tarn workshop to prepare the knife and carry out the engraving. This period begins on receipt of full payment and final confirmation of the personalisation details by the Customer.
  2. Delivery time: The time taken by the selected carrier to deliver the parcel to the specified address.

In the case of a mixed order (comprising both standard and engraved products), the entire order will be dispatched in a single consignment, subject to the lead time applicable to the product with the longest lead time, unless otherwise agreed in writing between Le Tarn and the Customer.

6.3 Delays in delivery

In accordance with Article L. 216-2 of the Consumer Code, if the delivery deadline specified at the time of the order is exceeded (unless the delay is due to an error in the Customer’s address or to a case of force majeure), the Customer may require Le Tarn, by registered letter with acknowledgement of receipt or in writing on another durable medium, to make the delivery within a reasonable additional period. If Le Tarn has not complied within this new deadline, the Customer may terminate the contract and receive a full refund of the sums paid within 14 days.

ARTICLE 7 – STATUTORY WARRANTIES

Notwithstanding the exclusion of the right of withdrawal for engraved products (Article 5.2), the Customer is fully entitled to the mandatory statutory guarantees provided for under French law.

7.1 Statutory guarantee of conformity

In accordance with Articles L. 217-3 et seq. of the Consumer Code, Le Tarn is liable for any lack of conformity existing at the time of delivery of the product and becoming apparent within two (2) years. If the engraving carried out contains an obvious error on our part (incorrect font compared to the order form, or a spelling mistake made by our workshop whilst the text entered by the customer was correct), Le Tarn undertakes to replace or repair the product at its own expense, at no additional cost to the Customer.

7.2 Statutory warranty against hidden defects

In accordance with sections 1641 et seq. of the Civil Code, the Customer may also invoke the warranty against hidden defects in the goods sold which render them unfit for their intended purpose. In the event of a hidden defect (e.g. a structural defect in the steel or an internal crack invisible to the naked eye), the Customer may choose between cancelling the sale or a reduction in the sale price.

ARTICLE 8 – RESPONSIBILITIES

Le Tarn undertakes to exercise all due professional care to ensure customer satisfaction. Nevertheless, Le Tarn shall not be held liable for any failure to perform the contract arising from unforeseeable circumstances or force majeure, such as, but not limited to, natural disasters, fires, floods, equipment failure or breakdown, transport or communication failures, or as a result of the customer’s actions.

Le Tarn shall not be held liable for any delay caused by a supplier.
In any event, Le Tarn’s liability shall be limited to the value of the order.

ARTICLE 9 – INTELLECTUAL PROPERTY

All content on the Le Tarn website is and remains its exclusive intellectual property.
No one is authorised to reproduce, exploit, redistribute or use, for any purpose whatsoever, even in part, any content from the website, whether it be software, visual material or audio.

ARTICLE 10 – SETTLEMENT OF DISPUTES

These online terms and conditions of sale are governed by French law. In the event of a dispute, the French courts shall have jurisdiction.
